In what many area lawyers are calling an illegal move, a Long Neck, Delaware condominium association is planning to fine homeowners $100 if they don’t attend the association’s annual meeting.
The Bayshore Condominium Association bylaws state that in order for it to conduct business, at least half of the condominium association residents must be in attendance at board meetings.
A letter was sent to residents on July 29th that stated: “Please be aware that the board passed an official resolution. If you are unable to attend the meeting and do not return your proxy/ballot, you will be assessed a fine of $100.”
Residents are furious, and have complained to the local media that the tactics are too harsh, and others have questioned the legality of levying and collecting such fines.
At the upcoming board meeting, the condo association is planning to deal with lawn maintenance contracts and insurance plans, as well as electing three new board members.The community is managed by CPR Property Management LLC, and that company drafted and sent the letter at the request of the association management.
